These Terms and Conditions of Sale ("Terms") apply to all purchases made through the webshop available on https://selivanmarketing.com/ (the "Website").

Please read these Terms carefully before placing an order.

2. Scope of these Terms

These Terms govern the sale of books and related products offered through the Website to consumers.

By placing an order through the Website, you confirm that you have read and accepted these Terms.

3. B2C only webshop, no B2B orders through checkout

This webshop is operated exclusively for sales to consumers (B2C), meaning natural persons acting for purposes outside their trade, business, craft, or profession.

Orders placed through the webshop checkout on behalf of a company, legal entity, sole trader, freelancer, association, or any person acting for professional purposes (B2B) are not accepted.

If we reasonably determine that an order placed through the webshop checkout is a business order, we reserve the right to refuse or cancel the order before dispatch and refund any amount paid.

Business orders may be accepted only through prior direct contact by email and are processed separately through manual invoicing, subject to separate approval and terms.

The buyer is responsible for providing accurate information at checkout. Any request to issue an invoice in the name of a company after an order has been placed through the consumer webshop checkout may be refused.

4. Products

We offer books and related products as described on the Website.

We make reasonable efforts to ensure that product descriptions, images, and specifications are accurate. However, minor differences in color, print appearance, packaging, or design presentation may occur due to screen settings, production batches, or supplier variations and do not constitute a defect.

Product availability is subject to stock and may change without notice.

5. Prices and taxes

All prices displayed on the Website are shown in the currency indicated on the Website.

Unless stated otherwise, prices are shown inclusive of applicable VAT where required.

Delivery charges and any other applicable costs are shown during checkout before the order is placed.

For orders delivered outside Belgium or outside the European Union, additional customs duties, import taxes, or local charges may apply depending on the destination country. Such charges are the responsibility of the buyer unless expressly stated otherwise.

6. Ordering process

To place an order, the buyer must follow the checkout steps on the Website and provide complete and accurate information.

Before placing the order, the buyer will be shown a summary including, where applicable:
- selected products
- quantities
- total price
- delivery costs
- delivery details
- payment method

The order is placed when the buyer confirms the order through the checkout process and completes the required payment step.

After the order is placed, the buyer will receive an order confirmation by email. The order confirmation does not necessarily mean that the order has been accepted for dispatch in all cases.

We reserve the right to refuse or cancel an order for legitimate reasons, including but not limited to:
- suspected fraud or abuse
- incorrect pricing caused by technical error
- stock unavailability
- payment failure
- breach of these Terms
- suspected B2B order placed through the B2C checkout

If an order is canceled after payment, any amount paid will be refunded using the original payment method where possible.

7. Payment

Payment must be completed using one of the payment methods made available at checkout, unless another method is expressly agreed in writing.

We may use third party payment providers to process payments securely.

We do not necessarily store full payment card details on our own systems when payment is processed by an external payment provider.

If a payment is refused, declined, reversed, or not completed, we may suspend processing or cancel the order.

8. Delivery and shipping

We deliver to the destinations shown on the Website or during checkout.

Delivery times are estimates unless expressly stated otherwise. We make reasonable efforts to ship and deliver within the stated time, but delays may occur due to carriers, customs, demand peaks, operational constraints, or events outside our control.

The buyer is responsible for providing accurate delivery information. We are not responsible for delays, failed delivery, or additional charges caused by incorrect or incomplete address details provided by the buyer.

If a parcel is returned to us due to failed delivery, non collection, refusal, or incorrect address details, we may contact the buyer to arrange reshipment at additional cost.

9. Transfer of risk and ownership

Risk of loss or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer (other than the carrier), physically receives the goods.

Ownership of the goods transfers only after full payment of all amounts due for the relevant order has been received.

10. Right of withdrawal for consumers

Consumers located in the European Union may have a legal right to withdraw from the purchase within 14 days without giving any reason, subject to applicable legal conditions and exceptions.

The detailed rules, conditions, deadlines, and procedure for exercising the right of withdrawal are set out in our Returns and Withdrawal Policy, which forms an integral part of these Terms.

A standard EU Model Withdrawal Form is also available on the Website.

11. Returns and refunds

Returns and refunds are handled in accordance with:
- applicable consumer law
- these Terms
- our Returns and Withdrawal Policy

If a return is accepted, refunds are made using the original payment method where possible, unless otherwise agreed and permitted by law.

We may withhold reimbursement until the returned goods are received or the buyer provides evidence of having sent back the goods, as permitted by applicable law.

12. Damaged, defective, or incorrect items

If the buyer receives a damaged, defective, or incorrect item, the buyer should contact us as soon as possible at selivan.marketing@gmail.com and include:
- order number
- description of the issue
- photographs where relevant

We may request reasonable evidence to assess the issue and provide an appropriate solution, which may include replacement, refund, or another remedy required by law.

Nothing in these Terms limits the consumer's mandatory legal rights relating to conformity of goods.

13. Consumer legal guarantees

Consumers benefit from mandatory legal guarantees under applicable law, including Belgian law and applicable European consumer protection rules.

These legal rights apply in addition to any commercial policy stated on the Website and cannot be excluded or limited by these Terms.

14. Promotional offers and discount codes

Promotions, special offers, and discount codes may be subject to specific conditions, including validity period, product eligibility, minimum order value, and stock availability.

Unless expressly stated otherwise:
- promotions cannot be combined
- discount codes cannot be exchanged for cash
- promotions apply only while available

We reserve the right to modify or withdraw promotions in case of error, abuse, fraud, or technical malfunction.

15. Intellectual property

All content on the Website, including text, graphics, logos, images, product presentation, and original materials, is protected by intellectual property rights and may not be used without authorization.

The purchase of a physical product does not transfer any intellectual property rights unless expressly stated otherwise.

16. Acceptable use and resale restrictions

The buyer agrees not to use the Website in a fraudulent, abusive, or unlawful manner.

We reserve the right to refuse orders where there is a reasonable suspicion of abuse, automated purchasing, unauthorized resale schemes, or other conduct that harms the Website, customers, or business operations.

17. Limitation of liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, gross negligence where applicable, or mandatory consumer rights.

Subject to the above, and to the extent permitted by law, we are not liable for indirect or consequential losses arising from the use of the Website or the purchase of products.

We are not liable for delays or failure to perform obligations caused by events beyond our reasonable control.

18. Force majeure

We are not responsible for delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including transport disruption, postal or courier disruption, customs delay, strikes, natural events, fire, epidemic, pandemic, power outage, or technical infrastructure failure.

In such cases, performance will be suspended for the duration of the event. If the disruption continues for an unreasonable period, either party may contact the other to seek an appropriate solution in good faith.

19. Privacy and cookies

Personal data is processed in accordance with our Privacy Policy.

Cookies and similar technologies are used in accordance with our Cookie Policy and cookie preference settings.

20. Changes to these Terms

We may update these Terms from time to time for legal, operational, or business reasons.

The version applicable to an order is the version published on the Website at the time the order is placed, unless mandatory law requires otherwise.

21. Governing law and disputes

These Terms are governed by the laws of Belgium.

If the buyer is a consumer residing in the European Union, mandatory consumer protection rules of the buyer's country of residence remain applicable where required by law.

In the event of a dispute, we encourage the buyer to contact us first at selivan.marketing@gmail.com so that we can attempt to resolve the matter amicably.
